Lasting Powers of Attorney

Lasting Powers of Attorney or LPAs are documents that set out who can make decisions about your finances, property, or health and care if you can no longer make decisions for yourself.

Losing mental capacity can happen at any time, either due to accident, injury or illness. We can take you through the details of making LPAs and ensure they are completed correctly in order that they can be used by your Attorneys when you need them. Once complete, we can ensure they are correctly registered with the Office of the Public Guardian and are ready for use.

We also offer advice regarding all manner of Court of Protection issues, including advice to Attorneys on the use of LPAs and applications to the Court in respect of issues including making gifts and decisions with regard to residential care or medical treatment.

Finally, you can appoint specific people as your Attorneys to look after or run your business under a Business or Professional LPA. We can help you complete this correctly so you have the reassurance that, should anything happen unexpectedly, you have made proper arrangements for your business to continue to trade.

How we work with you

If you would like to proceed to make LPAs with us, we will send you our terms and conditions of business with a brief questionnaire to take details from you.  We will also need to obtain a copy of your identification and proof of your address.

When we have this information, we will:

  • Send you an invoice for fifty percent of the agreed cost and request payment;
  • Arrange a meeting with you to take full instructions and explain how the LPAs operate and the work we will carry out to assist you in their creation.

Following this, we will:

  • Prepare the LPAs for your approval;
  • Create final documents for signature, assist you with the signing provisions and provide you with a Certificate of Mental Capacity (if required) to confirm that you have correctly and validly completed the LPAs; and
  • We will help you obtain the signatures of your Attorneys and any other supporting information that may be needed.

Finally:

  • We will submit your application for registration of the LPAs to the Office of the Public Guardian and guide you through the registration process; and
  • Once the documents are registered, we will provide you with the original documents and certified copies for your use.  Our final invoice will be submitted to you for payment once the process is complete.

Our Charges

The cost of one LPA (either for Financial & Property Affairs or Health & Welfare) is £350.

The cost of both LPAs (for both Financial & Property Affairs or Health & Welfare) is £550.

If LPAs are made for couples, with four LPA documents needing to be completed, the cost is £950.

This firm does not charge VAT.

The Office of the Public Guardian fee for registration of each LPA is currently £82.00. We will ask for the cost of the fee for registration at the time that application for the registration of the documents is made.
